Cualquier violación a lo antes mencionado, o a cualquiera de los términos y condiciones, resultará en la terminación inmediata de los servicios y creará una causa de acción civil en la que podremos reclamarle, entre otras cosas, daños y perjuicios e incumplimiento de contrato. En caso de que tengamos la necesidad de acudir ante un árbitro o un tribunal le podremos reclamar, y usted así lo acepta, la cantidad mínima de $25,000.

INDEMNIZACIÓN

Usted acepta indemnizar, defender y eximir de responsabilidad a Snow Project LLC y a nuestra matriz, subsidiarias, afiliadas, socios, funcionarios, directores, agentes, contratistas, otorgantes de licencias, proveedores de servicios, subcontratistas, proveedores, pasantes y empleados, indemnes de cualquier reclamo o demanda, incluidos los honorarios razonables de abogados, realizados por un tercero debido a su incumplimiento de estos Términos o los documentos que incorporan por referencia, o su violación de cualquier ley o los derechos de un tercero.

COMENTARIOS Y COMUNICACIONES DEL USUARIO

Si, a petición nuestra, usted envía ciertas presentaciones específicas (por ejemplo, participaciones en concursos) o sin una solicitud de nuestra parte, envía ideas creativas, sugerencias, propuestas, planes u otros materiales, ya sea en línea, por correo electrónico, por correo postal o de otra manera (colectivamente, "comentarios"), usted acepta que podemos, en cualquier momento, sin restricciones, editar, copiar, publicar, distribuir, traducir y de otra manera utilizar en cualquier medio cualquier comentario que nos envíe. SEPARABILIDAD

TERMINACIÓN

Las obligaciones y responsabilidades de las partes contraídas antes de la fecha de terminación sobrevivirán a la terminación de este acuerdo a todos los efectos. Estos Términos y Condiciones son efectivos a menos que usted o nosotros los rescindamos. Puede rescindir estos Términos y Condiciones en cualquier momento notificándonos que ya no desea usar nuestros Servicios o cuando deja de usar nuestro sitio. Si, a nuestro exclusivo criterio, usted no cumple o sospechamos que ha incumplido cualquier término o disposición de estos Términos y Condiciones, también podemos rescindir este acuerdo en cualquier momento sin previo aviso y usted seguirá siendo responsable de todos los montos adeudados hasta e incluyendo la fecha de terminación; y/o en consecuencia puede negarle el acceso a nuestros Servicios (o cualquier parte de los mismos). Cualquier discrepancia con estos términos y condiciones o con Snow Project LLC deberá ser evaluada y atendida por el tribunal competente en Puerto Rico. Este documento y cualquier otro acuerdo que tenga relación con los servicios o productos ofrecidos, se regirán e interpretaran de conformidad con las leyes de Puerto Rico.

INTERPRETACIÓN

Los títulos utilizados en este acuerdo se incluyen solo por conveniencia y no limitarán ni afectarán estos Términos. Las cláusulas de estos términos y condiciones deben de interpretarse conforme al contenido de los mismos y las leyes de Puerto Rico.

MODIFICACIONES

Snow Project LLC, y sus representantes, se reservan los derechos, a nuestro exclusivo criterio, de cambiar o modificar estos términos y condiciones sin previo aviso en cualquier momento, por lo que le recomendamos mantenerse revisando de tiempo en tiempo nuestras políticas. Es su responsabilidad revisar periódicamente nuestro sitio web para ver los cambios. A pesar de esto, la información personal provista por usted con anterioridad a la modificación no será utilizada en asuntos que sean materialmente inconsistentes con estos términos y condiciones, sin su consentimiento previo.
